 To consult measures click the sphere to your left… At the present stage the approximation of the Ukrainian legislation to the legislation of the EU takes place in accordance to the Law of Ukraine “On National Programme on Approximation of the Ukrainian Legislation to the Legislation of the European Union” of 18 March 2004 No 1629 (hereinafter refers to as – the National Programme).
The National Programme covers general aspects of the process of legal approximation, in particular: stages of implementation and goals of the first phase of implementation of the National Programme (2004-2007); consistency of the process of approximation; institutional mechanism, as well as the competence of the Verkhovna Rada and the Cabinet of Ministers of Ukraine in this context.
The National Programme combines elements of a strategy and operational document. It defines the strategic aim of the process of approximation of the Ukrainian legislation – meeting the requirements of the 3rd Copenhagen and Madrid criteria, as well as general mechanism of the approximation process.
For the implementation of the National Programme the Cabinet of Ministers of Ukraine approved the Regulation “On particular issues of Approximation of the Ukrainian Legislation to the Legislation of the European Union” of 15 October 2004 No1365 (Regulation No1365). In this Regulation the CMU approved the Order of preparation and fulfillment of the action plan for implementation of the National Programme on Approximation of Ukrainian Legislation to the Legislation of the European Union (Order) and the Regulations of the Coordinating Council for approximation of the Ukrainian legislation to the legislation of the European Union.
The measures on implementation of the National Programme are defined by the annual plans of measures (PoMLA). For the time being it were approved four PoMLAs elaborated by the State Department for Legal Approximation under the Ministry of Justice (SDLA) in co-operation with the line ministries. The plans are the lists of legal measures concerning mostly elaboration of draft legal acts (with indication of relevant acquis and competent bodies of executive power), and sometimes supporting in adoption by the Verkhovna Rada.
